The domain ofwww. homycasa. pt is owned by AVAILABLE PURPLE, Lda. based on Avenida de Santa Isabel, N°4-8, Cabra Figa, N249-4, 2635-047 Rio de Mouro, collective person 514 011 092, which is also the registration number in the Conservatory of the Commercial Register of Vila Nova de Gaia, with the social capital of 97,500€, from time to time called HOMYCASA. Navigation through the HOMYCASA website and its subdomains, as well as the purchase of any product presupposes acceptance of the following General Terms and Conditions of Sale. HOMYCASA reserves the right to change the pre-contractual information contained in this website, based on the Vigor Legislation, without any prior notice. The online sale of HOMYCASA products presented on this website is only valid and applicable in Continental Portugal and Islands (Açores and Madeira).
I - Your Order
a) It is the responsibility of the customer to verify that the item(s) you selected have the dimensions appropriate to the space where you want to place them and if the accesses to the destination location enable your delivery.
(b) The decoration props and complements, in particular, mattresses, layers and lamps, present in the environments and presented in the images of the site are not included in the price, except when expressly indicated.
(c) The colour shades of the article(s) in the presented images may seem different from reality as a result of factors such as lighting at the time of image capture and the particular characteristics of the materials, namely the shades of wood u of the skins, as well as other factors external to HOMYCASA itself, such as the characteristics of its computer equipment.
d) The information provided by HOMYCASA on the essential characteristics of the article(s) is elaborated taking into account the technical descriptions shared by its suppliers, and the photographs illustrating the products marketed in strict respect for the best market standards.
e) Customer to formalize any order on the sitewww. homycasa. pt must be registered, and must provide the elements requested to you in the most complete and rigorous manner possible.
Export Orders
Only requests for return of the value of VAT for the export of goods will be accepted, with the presentation of the respective export proof (DU), and are exclusive for purchases of value exceeding €3000 with VAT, per purchase.
II - Information on Content
a) HOMYCASA reserves the right to modify at any time the commercial information and offer presented on: products, prices, promotions, commercial conditions and services.
(b) All efforts have been made to ensure that the information presented here is free of typographical errors, writing and publication, and whenever they occur, HOMYCASA will proceed as soon as possible to correct it.
(c) The photographs presented on the site are merely illustrative. As such, HOMYCASA recommends that the Customer consult the detailed description of the product in order to obtain the complete information about their characteristics.
d) In the event that the information presented does not correspond to the actual characteristics of the product, the Customer assists in the resolution of the purchase and sale agreement in the applicable legal terms. (v. section below “Cancel exchange an order u freely resolve the contract”).

This does not mean that HOMYCASA supports these sites u recommend these products and services and has already declined any responsibility for their content. Customer accessing an external link should read and accept the conditions of that site before using it.
f) In the event that the information presented does not correspond to the characteristics, the price of sale to the public and the correct information concerning the availability of the product, the Customer will be informed and will only have the right to terminate his purchase.
g) Prices and specifications are subject to change without notice. In the case of product breakdownwww. homycasa. pt does not guarantee the product replacement and does not imply the price update, so in this case we only process the order after confirmation with the client itself. If the order is processed and a stock breakdown situation is still verified, HOMYCASA will inform you of this fact and make the due refund of the amounts paid within 30 days of the knowledge of the stock breakdown.
h) The color and tonality of the photos of the products may vary depending on the monitor on which they are viewed. In the same way, photographs may undergo variations of tonality and contrast due to lighting conditions at the time they were made.

III – Order and Order Processing
a) The customer will receive, within 48 hours of formalizing your order on the site www. homycasa. pt, an e-mail from HOMYCASA with the data relating to the intended article(s), with a summary, as detailed as possible, of its characteristics, the total value of the article(s), including fees and taxes, additional charges for transport, assembly, delivery, postal and other associated costs, in particular those for return under the terms provided for in Clause III. in the case of the article(s), which by their nature cannot be returned normally by normal mail, as well as the means of payment, the foreseeable date of delivery and its modality and other information which are relevant and necessary.
(b) The request made on the sitewww. homycasa. pt will be converted to order and this will be processed only after the effective payment of the total price indicated in the email received by the customer.
(c) It is considered, for all due and legal effects, that the date agreed and accepted by the parties, as expected for the fulfillment of the order, is the constant date of the email referred to in a.).
IV – Right to Free Contract Resolution
a) Shopping exclusively through our website www. homycasa. pt, The legal system provided for in the Dec applies. Law no24/2014 of 14 February, so the client has the right to free resolve the purchase and sale contract concluded with HOMYCASA, until the 14th calendar day after the day when he acquires a third party for himself, other than the carrier, acquires the physical possession of the article(s), and in the case of the client having ordered several articles in a single order and the articles delivered separately, the period begins to be.

(c) The customer shall, within 14 days of the notification of his decision to resolve the contract, return the article(s) to HOMYCASA, and the costs of the return of the contract, as a result of the exercise of the right of free resolution, are always the responsibility of the customer and to bear it.
d) In its turn and within the same period as indicated in the previous paragraph, HOMYCASA will reimburse the client of the amount paid by the article(s) including the delivery costs, with the exception of additional costs resulting from the client's choice of a different shipping mode of the less expensive mode of normal shipping offered by HOMYCASA, which will result in the same payment method that has been used in the initial transaction, unless otherwise express retention is.
e) The customer must keep the article(s) in order to be able to restore it in a new state and in due conditions of use, and must be careful to inspect the nature, characteristics and operation of the article(s), so that it does not exceed what is usually admitted in any commercial establishment, must be accompanied by all components of the original packaging, which must not be damaged by the penalty of the article.
f) The said customer's right to free contract resolution does not apply to article(s) manufactured in accordance with clearly custom customer specifications, the article(s) which, by nature, cannot be resented and may deteriorate and the article(s) which, after their delivery and by nature, are inseparably mixed with other articles.
V – Annulation of Orders
In accordance with the provisions of Decree-Law No 7/2004 of 7 January with the amendments referred to by Decree-Law No 62/2009 of 10 March and Law No 46/2012 of 29 August concerning e-commerce, HOMYCASA reserves the right to unilaterally cancel the order whenever any programming error is found, and/or defect of operation of the computers of the company.
VI – Price
a) Prices presented for the supply, delivery u assembling, do not include the use of special access u means, such as external stairs u cranes, u necessary changes of civil construction in doors, windows, stairs u other structures of the property
(b) The sales prices indicated in the e-mail proof of the order are valid between the date of payment of the order and the effective delivery date, regardless of the possible positive u negative variations of the sales prices and the campaigns practiced for the same articles, at that same time interval.
(c) Prices presented in homycasa. pt include VAT in force.
d) Prices presented in homycasa. pt can be different from physical stores.
VII – Date of availability of articles
a) The availability of the articles is indicated in the article sheet
(b) If there is no availability of the article, the expected arrival time of the item(s) to the warehouse is also indicated in the article sheet. This availability is an expected availability, based on the supplier's average production and delivery times. If there is any change to the expected period, we will contact the customer to inform such a situation.
(c) Delivery/lift time depends on the availability of the item(s) in the shipment/lift warehouse. If there is no item in the shipment/lift warehouse, the same must be transferred from another warehouse, and the average expected arrival time at the warehouse is 5 working days.
d) When the items are available for delivery/address, the customer will be contacted by our services.
VIII - Delivery and Assembly
HOMYCASA delivers in Continental Portugal and islands (Açores and Madeira), from Monday to Saturday at working hours, except express deliveries (from Monday to Friday at working hours.).
a) The customer, if so, may request our specialized assembly services, available when order is formalized, supporting their cost, which will add to the delivery. The delivery and assembly service does not include any type of disassembly of another article(s), namely furniture, existing on site. The assembly service is not available for delivery outside Portugal Continental.
(b) The customer must ensure that the space where the assembly is performed is clean and clear.
(c) Delivery and assembly services may advise delivery and/or assembly to meet, at the defined location, with access problems and the serious possibility of damage to articles. In this specific case, if the customer still intends to transport, delivery and assembly, such will be carried out, but under their responsibility and risk.
d) In case of a warehouse survey HOMYCASA u of unmounted delivery, the customer should check whether the outer packages are closed and have no signs of falling u humidity.
e) For the Azores and Madeira Islands, damage insurance is not included.
Packaging should always be opened by the indicated areas.
At the time of delivery, you must check the article(s) and, in case of assembling our services, if it has complied with. In the event of anomalies, deconformities, they must be duly recorded, immediately and in their own document. You must also contact HOMYCASA for Customer Service sell. online@homycasa. pt, in the next 2 days after the delivery date.
Timeline for Order Pickup:
a) Orders must be raised/delivered up to 30 days after the confirmation date of u withdrawal in the first scheduling contact. From that time on, HOMYCASA reserves the right to charge storage expenses on the order items, and will only be refunded upon payment of storage expenses, in the daily amount of €5 per item.
(b) After 30 days without the customer having proceeded to the withdrawal of the order HOMYCASA has the right to resolve the Agreement, communicating to the Customer for the e-mail indicated by the Customer in the Order Note the resolution of the contract and restoring to the Customer the value of the goods acquired, being deducted from this amount the values due by the Customer for the storage of the goods, under this Cláoula.
(c) In the event that the customer intends to cancel the sale and be reimbursed of the value of the refund, the amount of the refund will be deducted.
IX - Payment
HOMYCASA provides the following means of payment for purchases at www.homycasa. pt:
1. ATM reference (in box ATM u via Home Banking:) At the end of the order HOMYCASA will send you a confirmation email, providing you with the necessary data to pay your order. Entity, Reference and Amount are also included in the confirmation email sent by HOMYCASA, so that you can pay your order in any of the Multibanco network boxes using the Purchase Payment option. Payment must be made after order is made. If this does not occur within 24 hours of order completion, HOMYCASA reserves the right to cancel the order.
2. Bank transfer: At the end of the order HOMYCASA will send you a confirmation email, providing you with the necessary data to pay your order by bank transfer (IBAN.) For faster handling of the order, we suggest that you refer the proof to the e-mail storeonline@homycasa. pt with proper order reference.
3. Card (VISA/Mastercard): You can pay using one of the VISA and Mastercard credit cards
4. Payment by MB Way – when choosing this option, you will need to place your mobile number on which you have the MB Way account active. Then you'll receive a notification on your phone to give your payment permission.
Five. Payment by Payshop – generates a Payshop reference that can be paid in a Payshop u agent at a CTT post.

X - Warranty
a) Articles sold by HOMYCASA benefit from a 3-year guarantee for the final consumer and 6 months for the professional, counted from the date of purchase and/or delivery, when it differs from that.
If you verify any anomaly in the article during the warranty period you should transmit this information to our Customer support u directly at any HOMYCASA store.
HOMYCASA may, if necessary, make a prior evaluation, with the removal of a technician to the place where the delivery and assembly was carried out, and the customer should, in this case, be made available to receive it, on schedule according to the availability of our services.
(b) In the case of an article(s) received by the customer in KIT and without assembling for our services, the customer may request a prior evaluation at the assembly site, provided that within our delivery zones, and supporting the cost of the transfer, at the amount equal to the charged, at each time, for deliveries.
This value will always be refunded if it is a defect covered by the warranty.
(c) Mattress Guarantee:
Our mattresses have the highest quality and undergo tests at each stage of the manufacturing process.
To increase the service life of the mattress, this should be rotated horizontally, inverting the side of the feet and the head. Soon after, it should rotate vertically (when the mattress is 2 faces), turning up the face that was before down. This operation should be repeated from 2 in 2 weeks in the first 6 months. After this period, the mattress should be turned monthly.
Our mattresses meet the European standard for measures in rest products, UNE-EN 1334: height/width (+20 mm.-20 mm).
The warranty does not cover damage derived from the following circumstances:
- Negligent use (pisar, jump, support heavy and sharp objects directly on the surface of the product) u improper use of the product and inadequate to its function.
- Improper installation and use of the product for its correct technical operation, as well as the use of the base mattress u with other products in poor condition, thus providing the instructions for oo and maintenance.
- Accidents, water, fire, little ventilation u any cause of greater force, completely unpredictable.
- Improper transportation, such as: transport the product in the car roof, fold it for transport in the elevator u in any other location of size lower than the mattress volume.
- Use of non-suitable energy (in electric motors, articulated beds.).
- Use of spring mattresses in articulated layers.
- Use of non-suitable cleaning products (dissolvents, bleach) that can cause irreparable damage to the mattress tissues.
- Manipulations by entities outside HOMYCASA.
- Transfer from the mattress to another address after delivery at the order address.
XI - Return and Exchange of Articles
In the first 14 days after purchase and if you are not fully satisfied with your purchase, you can exchange for other items in our catalogue, presenting the purchase documents and provided that the item has not been assembled u used and is properly packaged in the source packaging. The value will be credited to your customer account. In this situation, and if applicable, the costs inherent to transport will always be the responsibility of the customer.
No trade in textile articles, exhibition pieces, decoration and mattresses are accepted, where the packaging is open, as well as custom made furniture with changes on request from the customer.
The return can be made in two ways:
• In a store HOMYCASA - The client must prove to be the owner of the article, presenting the invoice corresponding to the product he intends to return. You should take into account the operating hours of the warehouse for return purposes. Check time here
• By carrier – The customer will have to make the order to the Customer Support team by phone210 999 452(Call for national fixed network) u by email sell. online@homycasa. pt. The customer shall be charged with all the shipping expenses of the returned articles.
XII – Refund
The refund is made by the same means of payment u in offer voucher, according to the will expressed by the Customer. In the case of payment by ATM, Bank Transfer u Payshop, HOMYCASA asks the customer to send the IBAN voucher in which they identify the account holder. If the payment is by MB-way u VISA, the refund is made directly to the account. If the payment has been made by Klarna, the refund is made directly to the card associated with the purchase.
1) The refund will be made after confirmation by the HOMYCASA services of the good condition of the returned articles.
(2) HOMYCASA will refund a maximum of 5 working days after receipt of the articles.
(3) All articles that do not come with packaging of intact origin cannot be repaid.
4) No refunds of products purchased whose return is made after 14 days
XIII - Dispute Resolution
For any dispute arising out of the application of these Terms and Conditions the consumer may appeal to Entities of Alternative Resolution of Consumer Disputes proceeding to dispute settlement through mediation, conciliation and arbitration procedures outside the courts.
